Kyle Busch Lawsuit Settlement Ends $8M Insurance Dispute

Lincoln County, N.C. — Kyle Busch and his wife Samantha have settled their lawsuit against Pacific Life Insurance Company concerning an $8 million dispute, according to a federal court filing dated February 26. The NASCAR Cup Series driver, who is a two-time champion, had accused the insurer of selling misleading life insurance policies intended as retirement plans.

Background of the Busch Family’s Legal Complaint

The legal action filed by the Busches in October 2025 claimed they suffered losses exceeding $8.5 million after investing over $10.4 million in premiums for indexed universal life insurance policies. These policies were promoted as safe retirement plans featuring guaranteed returns, although the Busches alleged the projections were speculative and failed to disclose real risks and associated costs.

The lawsuit further accused Pacific Life and one of its agents of marketing these policies under false pretenses, emphasizing supposed tax-free benefits that were not properly explained. The couple also alleged that the company ignored warnings by keeping an agent with a disciplinary history and focused on commissions rather than the customers’ best interests. The suit invoked North Carolina’s Unfair and Deceptive Trade Practices Act.

Insurer’s Defense and Legal Proceedings

Pacific Life responded by seeking dismissal in January, arguing that the Busches had not fully funded the policies and had signed agreements acknowledging the terms. The insurer also maintained that the claim was barred by the statute of limitations, since the lawsuit was initiated seven years after the policies started, exceeding the three-year legal limit.

The case initially began in Lincoln County Court but was later transferred to the U.S. District Court for the Western District of North Carolina as the legal dispute continued.

Settlement Achieved with Confidential Details

The February filing did not disclose the settlement terms, only stating that the parties were finalizing paperwork and intended to request dismissal within 30 days. In a statement to WCNC Charlotte, Pacific Life said,

“The Busch family and Pacific Life are pleased to have reached an amicable resolution of their dispute,”

“Both sides worked constructively to achieve a confidential result that is mutually acceptable and avoids further legal proceedings.”

Representatives for the Busch family have not publicly commented since the announcement.
